Viltier has its head office at 46 rue de Verneuil, 75007 Paris.

These Terms of Use (“Terms of Use”) govern your use of the Viltier Platforms. In these Terms of Use, we use the term Viltier (“we”, “us” and “our”) to refer to Viltier’s registered office located at the address set out above.

Please read these Terms of Use carefully before using the Platform. By using the Platform, you signify your consent and agreement to these Terms of Use. If you do not agree to these Terms of Use, you are not permitted to continue using the Platform.

UPDATES TO THESE TERMS OF USE

We may make changes to these Terms of Use at any time, so please check back regularly to stay informed of any updates. The latest version of these Terms of Use will always be available on the Platform. Any new version of these Terms of Use will take effect and govern your use of the Platform, and your relationship with us, immediately upon its publication date. By continuing to use the Platform, you agree to be bound by the provisions of such updates and modifications.

ACCOMMODATION

The hosting services for the Viltier site are provided by OVH.

OUR PRIVACY POLICY

Our information collection practices on the Platforms, such as the types of information we collect about visitors to the Platforms and the ways in which we may use such information, are governed by the provisions of our Privacy Policy and Cookie Policy .

VILTIER ONLINE STORE - CONDITIONS OF SALE AND RETURN AND EXCHANGE POLICY

Customers purchasing products online or by telephone through the Viltier Customer Relations Center should read the General Conditions of Sale governing the terms of such purchases. The provisions entitled “Limitation of Liability” below do not cover the sale of products online or by telephone. Please refer to the Conditions of Sale for the relevant exclusions and limitations of liability.

USE OF PLATFORM DOCUMENTS

Viltier has created its various Platforms in order to provide information about its company and its products for your personal use. Although considerable efforts have been made to ensure that the visual representations of Viltier products displayed on the Platforms are representative of the color, design, style, etc. of the original products, slight variations, distortions and/or differences may appear compared to the original product. This may be due, for example, to technical problems such as the settings of your browser or computer. Accordingly, Viltier and the Supplier cannot be held responsible for any apparent differences between the images of the products represented on the Platforms and the original products. We strongly advise you to visit our showroom or one of our retailers before making a purchase online or by telephone.

You may download a computer copy or print a copy of the material made available to you via the Platforms solely for your personal use and for private or domestic and non-commercial purposes provided that all proprietary notices, including intellectual property notices, such as copyright©, trademarks™, are kept intact and are not deleted or altered. Unless otherwise indicated, you should assume that everything you see or read on the Platforms (such as creations or products, images, photos, including any person depicted in the photos, illustrations, icons, text, video clips, music, written or other materials) ("Viltier Material") is protected by law, including any laws protecting copyright, designs and trademarks, as well as by virtue of the provisions of international treaties and national laws around the world.

You may not sell, reproduce, distribute, communicate, modify, display, publicly perform, report, or otherwise create derivative or second-hand works based on any Viltier Document or use said Document in any way for any public or commercial purpose. In addition, a Viltier Document may not be posted or communicated on any other platform, in a networked computer environment, or on any other digital platform for any purpose. In the event of a violation of any of these Terms of Use, your authorization to use a Viltier Document will automatically terminate and all copies made of said Viltier Document must be immediately destroyed. Any unauthorized use of a Viltier Document may violate copyright laws, trademark laws, the laws of privacy and publicity, and communications regulations and statutes.

YOUR UNSOLICITED SUBMISSIONS AND COMMUNICATIONS

This section concerns communications sent to Viltier. It does not concern the communication of personal information to Viltier in relation to customer requests, use of services or purchase of products by telephone or through the Platform. The latter is governed by the rules set out in the Privacy Policy .

Any unsolicited communication or material you transmit to Viltier through the Platforms or via social media, by email or otherwise, including, but not limited to, data, questions or answers, comments, suggestions or the like, will be treated as non-confidential and non-proprietary by Viltier.

Furthermore, Viltier has a worldwide reputation for both designing and manufacturing high-quality luxury items. To this end, it has its own creative sources, including highly skilled teams of designers who design and perfect Viltier’s creations. Consequently, Viltier cannot agree or accept to be the recipient of unsolicited proposals for collaboration. Indeed, it is conceivable that Viltier is already working on similar ideas and/or creations. Therefore, we inform you that Viltier is not interested in receiving ideas or other proposals relating to creations that you would like to present.

LIMITATION OF LIABILITY

This section applies to the Platforms and not to products that may be sold online or by telephone through any of our local or regional marketplaces.

Viltier strives to ensure that the information provided is accurate and complete. However, Viltier cannot guarantee implicitly or explicitly that any Viltier Document is accurate, exhaustive or reliable, or that the use of said Viltier Document will not infringe the rights of third parties.

Viltier and the Supplier do not guarantee that the functional and/or technical aspects of the Platforms or any Viltier Documents are error-free or that the Platforms, Viltier Documents or the servers enabling their availability are free of viruses or other harmful components. If the use of the Platforms or any Viltier Documents results in the need to repair or replace property, materials, equipment, data or other items, Viltier and the Supplier will not be responsible for these costs. Without limiting the foregoing, all materials provided to you on the Platforms are provided on an “AS IS” AND “AS AVAILABLE” BASIS AND, UNLESS OTHERWISE REQUIRED BY LAW, WITHOUT WARRANTY OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, WARRANTIES OF MERCHANTABILITY, SATISFACTORY QUALITY, FITNESS FOR A PARTICULAR PURPOSE, REASONABLE CARE AND SKILL, OR NON-INFRINGEMENT OF INTELLECTUAL PROPERTY RIGHTS. Viltier and its suppliers make no warranties regarding any Document, software, text, downloads, graphics, or links on Viltier, or any warranties as to the results that may be obtained from using the Platforms.

Unless otherwise required by law, Viltier and the Supplier shall not be held liable for any direct or indirect damages, of any nature, cause, origin or consequence whatsoever, resulting from the use of the information available on the Platforms or in relation to the use of said information, or held liable for any loss of use, interruption of business, loss of profits or data, whatever the form of action, even if Viltier and/or the Supplier has been advised of the possibility of such damages occurring.

Please note that in some jurisdictions, consumer protection laws may not allow certain exclusions or limitations of warranties or liability and, therefore, some of the above exclusions and limitations may not apply.

TRADEMARK NOTICE

In general, all trademarks, logos and service marks (collectively the “Trademarks”) that appear on the Platforms are registered, unregistered or otherwise protected Trademarks of Viltier or are used under license to Viltier by third parties. Other trademarks are proprietary trademarks and have been registered by their respective owners. Nothing contained on the Platforms should be construed as granting, by implication or otherwise, any license or right to use any Trademark without the prior written permission of Viltier or the third party that owns the trademark. Misappropriation of any Trademark displayed on the Platforms, or any other content on the Platforms, is strictly prohibited, except as otherwise provided herein.

COPYRIGHT NOTICE

All content (including Viltier Materials) on the Platforms is either copyrighted (Copyright©) by Viltier or licensed to and used by Viltier. All rights are reserved. Please refer to the section above regarding use of Materials on the Platforms.

LINK AND CONNECTION

The Platforms may contain links to other platforms operated by third parties not affiliated with Viltier. The inclusion of any link to such third-party sites does not imply endorsement by Viltier of such sites. Viltier has not reviewed the entire content of such linked sites and is not responsible for the content or accuracy of any off-site pages or any other sites linked to any of our Platforms. If you choose to click on a link to any off-site pages or third-party sites, you do so at your own risk.

Viltier does not authorize any link to any of its Platforms from a third-party platform without its prior written authorization.

TERMINATION AND SUSPENSION

You agree that Viltier may, without prejudice to its other rights, terminate or suspend your access to and use of the Platforms, with or without notice, in the event of your breach of any of the provisions of this agreement, or in the event of your violation of the rights of Viltier, its affiliates or a third party. You agree that Viltier may modify or suspend access to any of the Platforms, with or without notice. You agree that Viltier and/or the Provider shall not be liable to you or any third party as a result of such modification or suspension. The provisions entitled “Limitation of Liability” and “General Provisions” shall survive the termination of these Terms of Use.

GENERAL PROVISIONS

Unless otherwise stated, the information and materials presented on the Platforms are presented solely for the purpose of promoting Viltier’s products and services and, in some cases, presenting products for sale through a variety of means. Viltier makes no representation that the Viltier Materials are appropriate or available for use in all countries throughout the world. You are responsible for compliance with applicable local laws, while keeping in mind that access to the Viltier Materials may not be legal by certain persons or in certain countries. Our products are available in many parts of the world. However, the Platforms may identify products that are not available worldwide.

If one or more provisions of these Terms of Use are held to be invalid or considered as such under any law, regulation or final decision of a competent court, they will be deemed unwritten and the other provisions will remain in force.

These Terms of Use constitute the entire agreement between you and us relating to the use of the Platform and supersede and extinguish all prior agreements, draft agreements, arrangements, undertakings or collateral contracts entered into by the parties, of whatever nature, whether oral or written, relating to such subject matter.

The waiver of its rights by Viltier following the violation of any of the provisions of these Conditions of Use may not be interpreted as a waiver of its rights following any other violation or subsequent violation.

APPLICABLE LAW AND JURISDICTION

These Terms of Use shall be governed by and construed in accordance with the laws of Switzerland, without reference to conflict of laws provisions. Any dispute, controversy or claim arising out of or in connection with the Terms of Use, including the validity, invalidity, breach or termination thereof, shall be settled or arbitrated in accordance with these Terms of Use. Where the laws of Switzerland are different from mandatory consumer laws in your own country, we will provide you with similar protection.
