The Terms of Sale may be amended at any time. Please check back regularly to be informed of any updates. Any new version of these Terms of Sale will be effective immediately on the date of publication and will govern all orders for products or services placed on or after that date. Any changes made to the Terms of Sale after you have placed your order will not affect your order or your relationship with us, except as required by applicable law.

CONCERNING VILTIER AND THESE CONDITIONS OF SALE

These Terms of Sale apply to all sales of Viltier products or services that you may order from our Selling Entity (as defined below), on the Website and by telephone via our customer relations center (the “Customer Relations Center”).

The Selling Entity that will sell you the products will depend on the delivery address of the products (“Selling Entity”, “Viltier”, “we”, “ourselves” and “our”):

Please read these Terms of Sale carefully. These Terms of Sale apply to any order placed through the Platforms or the Customer Relations Center (collectively the “Sales Channels”). Please note that before ordering any products or services, you will be asked to accept these Terms of Sale. If you do not accept these Terms of Sale, you will not be able to order any products or services through the Sales Channels. Sales concluded through physical points of sale (such as our stores) or through third parties (such as authorized resellers) are not subject to these Terms of Sale.

CONDITIONS OF PURCHASE

Only natural persons (and not legal entities) who (a) have reached the age of legal majority required to enter into contracts (eighteen years in most countries); (b) have the legal capacity to enter into contracts; and (c) use a shipping address in the country(ies) we serve (as indicated by the Sales Channels), may order products through the Sales Channels. If you are under the age of legal majority or for any other reason do not have the legal capacity to enter into contracts, your parent or guardian will need to place your order on your behalf and will be asked to accept these Terms of Sale.

By placing an order through the Sales Channels, you represent and warrant that you are a bona fide customer and end user making a purchase for your own use or the personal use of a third party, and that you will not deliver, sell or otherwise distribute our products, or purchase our products or services for any commercial purpose.

AVAILABILITY AND QUANTITY OF PRODUCTS

All orders placed through the Sales Channels are subject to availability and our acceptance of such orders. Products displayed on the Platforms that cannot be added to the shopping cart are not available for sale on the Platforms. The Customer Relations Center can provide more information regarding these products. For information regarding the ordering process, please refer to our Ordering Process article below.

Quantity limits may apply to orders for certain products. We reserve the right to refuse orders exceeding a certain number of authorized products at any time, without notice.

ACCOUNT REGISTRATION AND VALIDATION OF VISITOR PURCHASES

To place an order, you can either register and create an online account or place an order as a guest without creating an online account by selecting the "Guest Checkout" option. When you place an order as a guest, we may still create an account in our internal systems to record your purchase(s).

For purchases with a delivery address in France: In accordance with Article L.223-2 of the Consumer Code, we inform you that you are entitled to register on the “Bloctel” list to oppose telephone canvassing, a practice that Maison Viltier does not use. For more information, we invite you to refer to Viltier's Privacy Policy.

CUSTOMIZATION SERVICE

The customization service is offered on a selection of products. If you wish to have your product customized, please provide the information requested in the Sales Channels.

Viltier reserves the right to withhold or refuse to accept any order for personalized products or products accompanied by a message card containing unacceptable, illegal or policy-infringing language. It is your responsibility to ensure the accuracy of any information you provide regarding the products to be personalized.

Orders for personalised products are not cancellable and products that have been personalised cannot be returned to us for exchange or refund as described in these Terms of Sale. This clause does not affect your consumer rights.

ORDER PROCESS

The process of ordering the Platforms will include the following steps:

- Add to Cart: Once you have selected a product, you can add it to your cart. You can then decide to continue shopping and add it to your cart (subject to availability and quantity limits). Placing an item in your cart does not guarantee its availability at the time of purchase, which is only confirmed once you have received written confirmation of order and shipment.

- Visitor/My Account Purchase Validation: When you are ready, you then proceed to "validation", either as a visitor or through your registered account. You can also remove from the cart one or more products that you selected during the validation process.

- Shipping, Verification and Payment: During the checkout process, you add and verify your order details and personal information (including email address, shipping address, billing address and payment details). You must carefully review and confirm all details appearing on the order summary page before placing your order.

- Placing an order: you then check the corresponding box and place your order.

If an order is placed through the Customer Relations Center, the Viltier Ambassador will guide you through the above steps and verbally ask you to confirm the details of your order.

We reserve the right, in our sole discretion, to refuse, cancel or terminate orders at any time for reasonable reasons. For example, we may refuse, terminate or cancel your order if there is an ongoing dispute regarding payment for a previous order or if we suspect, in our sole discretion, that you have engaged in (i) fraudulent activity; or (ii) any other violation of these Terms of Sale.

PRICES, TAXES AND DELIVERY CHARGES

Unless otherwise stipulated, all prices indicated on the product pages of the Platforms or indicated by the Customer Relations Center include sales taxes/VAT (except for countries outside the euro zone, and the US) and include delivery costs and all other taxes.

The applicable currency will be updated according to the delivery destination after you have provided us with the delivery address and will be mentioned on your shopping cart before you place your order. You should carefully check the updated prices as well as the applicable currency.

Sales taxes or use taxes will vary depending on where the products are delivered.

Delivery charges are described, where applicable, in the Shipping Policy set out below or on the Sales Channels. Delivery charges are not shown on the product pages but will be added to the product price after you have chosen your delivery options. A summary of these charges will be provided before you are asked to confirm and place your order, and these charges will also be included in the emails we exchange with you once you have chosen your delivery options.

We may offer a VAT refund mechanism if you decide to have the products delivered to certain countries in the European Union and, no later than thirty (30) days later, to export them outside the European Union under certain conditions. Such a mechanism will not be available to customers in the European Economic Area. For more details, please contact our Customer Relations Center.

We can offer a VAT refund mechanism if you decide to have the products delivered to Switzerland and, no later than thirty (30) days later, to export them out of Switzerland under certain conditions. For more details, please contact our Customer Relations Center.

We reserve the right to change prices and delivery charges at any time without notice.

We take care to ensure that the prices of products and delivery charges are correct at the time the relevant information was entered into the system or communicated to you via the Customer Relations Centre. However, despite our reasonable efforts, it is still possible that the price of some of the products offered through our Sales Channels or the delivery charges may not be accurate. If the price of any of the products you order or the delivery charges are incorrect, we will contact you as soon as possible to inform you of the error. If we are unable to contact you using the contact details you provided during the order process, we will cancel the order and notify you in writing. If we accept your order in error and process it when an error occurs in the stated prices or delivery charges, we may cancel the supply of the product and refund any sums you have paid.

Please note that changes in applicable law between the date you place your order and the date you receive a written Order and Shipping Confirmation may change the taxes associated with your order. If the resulting change results in an increase in the taxes you are charged, we will contact you and ask you to reconfirm your order.

PAYMENT

We accept the payment methods identified as part of the order process via the Sales Channels. Depending on the payment methods, we may request additional information, including any form of special identification.

When ordering on the Platforms, you will be required to provide your payment details on the appropriate form. In the case of an order placed by telephone, you will be required to provide your full payment details to the Customer Relations Centre. All payment card holders are subject to a validation check and authorisation procedure by the card issuer. If your payment card issuer refuses to authorise payment to us, you will need to contact them directly to resolve the issue.

Other payment methods may also be subject to validation checks and an authorisation process by payment system providers. You expressly authorise us to perform security checks as we deem necessary, to transmit or obtain information (including updated information) about you to or from third parties from time to time, including but not limited to your payment card details, in order to authenticate your identity, validate your payment card, obtain an initial payment card authorisation and authorise individual purchase transactions.

The full amount of your purchase will usually be held on your payment card until your order is shipped, at which time an Order and Shipping Confirmation will be sent to you and your payment card will be charged the applicable purchase price.

When you use a credit/debit card or any other instant payment or payment capture solution offered on the Platforms as a payment method, the full amount of your purchase may be taken immediately after you place your order. Prepayment does not affect your rights under these Terms of Sale (including, for example, any right to a refund). Once your order has been shipped, you will receive an order and shipping confirmation. If we are unable to meet our shipping and/or delivery obligations as set out below, we will notify you by email and refund your prepayment as soon as possible. For credit/debit card payments, the full amount of your purchase may be blocked on your payment card until your order has been shipped. You will then receive an order and shipping confirmation, and your payment card will be charged the applicable purchase price.

We may accept any bank transfer in payment of orders at our sole discretion. We do not charge a bank transfer fee for any order placed through the Sales Channels or Customer Relations Center. However, some banking institutions may charge bank transfer fees. We require that all orders paid by bank transfer and placed over the phone be confirmed through an order approval process. We may acknowledge receipt of an order paid by bank transfer, but the order will not be processed until we have received payment and have confirmed receipt by email. If your bank transfer is not credited to our bank account within seven (7) days of placing your order, your order will be cancelled.

ACKNOWLEDGMENT OF RECEIPT OF ORDERS

Once you have made your selection and placed your order through the Sales Channels, you will receive an Order Acknowledgement (by email or otherwise) confirming the details of your order and an order reference number. Please retain this order reference number for future reference or inquiries regarding your order. This Order Acknowledgement does not constitute acceptance of your order. In order to confirm the order, we will carry out customary legal credit, fraud, security and related checks and, if satisfactory, we will then process your order. Upon receipt of the Order Acknowledgement, it is your responsibility to review it and confirm that it accurately reflects your intentions to order. If you have any questions or concerns or if the Order Acknowledgement does not reflect your intentions, you should promptly contact the Customer Relations Centre.

These Conditions of Sale will be provided to you as soon as we acknowledge receipt of your order.

ORDER SHIPPING POLICY

We only accept orders for delivery to the country(ies) identified during the Order Process. Please note that we will not ship to certain addresses, such as military zones, certain restricted areas, pick-up points or PO boxes. For more information, please contact the Customer Relations Center.

We will notify you by email or phone when the product is ready for collection in store.

If you order multiple products, we will only ship the order once all products are available.

ORDER CONFIRMATION AND SHIPPING

We will send you a written Order and Dispatch Confirmation (by email or otherwise) at the time of dispatch of your order. This Order and Dispatch Confirmation constitutes our acceptance of your order, indicating the existence of a legally binding contract of sale.

DELIVERY

We will use reasonable efforts to ensure that delivery is made by the carrier within the estimated delivery times from the date of our written Confirmation of Order and Dispatch, and in any event within thirty (30) days of that date, unless your purchase is for a product or service which will require additional delivery time as explained to you by us, for example in the case of products or services which we personalise or manufacture to your specifications.

If delivery of Products is delayed by an event outside our control, we will inform you as soon as possible and will use our reasonable endeavours to minimise the consequences of the delay. If we fail to deliver within thirty (30) days of the date of the written Order and Dispatch Confirmation or such other time as we may specify, you may contact the Customer Relations Centre to cancel the relevant order and obtain a refund of any sums you have paid us on account in respect of any Products you have not received.

In any event, your right to cancel an order and receive a refund of any amounts you have paid to us on account for any products you have not received is your sole remedy if we fail to deliver the order in question.

When estimating your delivery time, please take into account the time for payment approval, address verification, security checks and order processing. Please note that delivery is always subject to receipt of your full payment.

We will require a handwritten or electronic signature from you, or from any person at the specified delivery address (unless you make other arrangements), to confirm delivery of each product, after which the risk and liability for the products you have purchased will pass to you. If you have specified a recipient other than yourself for delivery (for example, if it is a gift), you understand and agree that a signature from said recipient (or from a person at the delivery address) constitutes proof of delivery and acceptance of the sales contract by Viltier, implying a transfer of liability to the recipient's address, as if the product had been delivered to you. For certain categories of products, we reserve the right to deliver the products only to the person who is the intended recipient of the order as indicated on the parcel label, and to request an identity check for verification purposes at the time of delivery. Please refer to our FAQ section or call our Customer Relations Center for information.

INVOICES

After ordering products through the Sales Channels, you will receive an invoice sent to you in writing (to your email address as a PDF attachment or otherwise).

RETURNS AND EXCHANGES POLICY

This Returns and Exchanges Policy details your options regarding how you can cancel a contract with us, how you can return your purchase and your rights in relation to obtaining a refund or exchange.

Right of cancellation

You have the right to cancel the contract created by our written order confirmation without giving any reason within 30 days from the day on which you acquire, or any person you nominate (other than the carrier) acquires physical possession of the products in your order. If you are a customer located in the European Union, the United Kingdom or the European Economic Area and you have made a purchase through the Sales Channels, this should be considered your statutory right of withdrawal. In order to meet the withdrawal period, you simply need to withdraw before the withdrawal period has expired.

To cancel the contract and return your product(s), you can contact our Customer Relations Center and follow the instructions that will be given to you, or you can send us an unequivocal statement in writing, such as a letter or an e-mail to the following address: maisonviltier@viltier.com

Return Process

Products purchased through the Sales Channels may only be returned to the following address: 46 rue de Verneuil, 75007 Paris.

Items purchased in Viltier retail stores can NOT be returned to said address.

To return a product to our e-store distribution center, you must follow the steps mentioned below:

1. Contact the Customer Relations Center by phone or email;

2. You agree a collection date with our logistics partner. You may be asked at this stage to provide information about the product so that we can make an initial assessment of its condition;

1. Please fill out the return form (HERE) and sign it. If you need a new copy, the Customer Relations Center will send you a return form by email;

2. You must include in the package the completed return form with the product as well as all its accessories, the free items you received as part of your order, the Service Guide, the Warranty Card and all other documents, in their original box;

1. Please close the packaging

2. On the agreed date, our logistics partner will collect the closed package.

You must retain proof of return shipping, and we will not be liable if you are unable to provide such proof. Only goods received by our Viltier e-shop distribution center will be eligible for a refund or exchange. If you decide to use a logistics partner other than the one we provided, you will be responsible for any risk of loss or damage to the product during transport until the product is in our possession.

Product return conditions

We will verify that the returned product meets the conditions of the Returns and Exchanges Policy and, if so, we will proceed with the applicable refund or exchange.

Our products must be returned in new and undamaged condition, in perfect condition, with all protective materials in place and accompanied by the labels and stickers affixed to them (if applicable), as well as the original Viltier box and packaging, including all accessories and documents. We reserve the right not to accept any return if the product shows signs of wear, or has been used or modified from its original condition in any way or, we may reduce the amount of any applicable refund or exchange accordingly.

If you received free items as part of your order, they must be returned with the products.

All returns will be subjected to a rigorous Quality Control (“QC”) by us to ensure that the returned products comply with these quality requirements. If the products do not meet the QC standards, we will refuse the return, and the products will be returned to you. If the returned product meets the QC, we will proceed with the applicable refund or exchange.

Failure to comply with these Conditions of Sale will give us the right to refuse the returned product and return it to you, at your expense.

Non-exchangeable and non-refundable products

Orders for products that have been custom-made for you in any way cannot be cancelled and such products cannot be returned to us for exchange or refund. This includes products that have been engraved or embossed.

Refunds

You may return a product purchased through the Sales Channels for a refund, provided that the return complies with these Conditions of Sale, in particular (a) the Right of Cancellation or Withdrawal (b) the Return Process above.

In the event that the return complies with these Conditions of Sale, the buyer is in principle reimbursed using the same means of payment as that used by the buyer for the initial transaction, within thirty (30) days from the date of receipt of the request for withdrawal. However, we may defer the reimbursement until the day of receipt of the product that is the subject of the return (or, if earlier, within thirty (30) days following the day on which you provide proof of the return of the returned item), the date retained being that of the first of these facts. The initial shipping costs will be reimbursed, excluding the case where you have opted for non-standard delivery, in which case the additional costs will not be reimbursed.

Exchanges

You may return a product purchased through the Sales Channels and exchange it for another Viltier product, provided that the return complies with these Conditions of Sale, in particular (a) the Right of Cancellation or Withdrawal and (b) the Return Process above.

In any case, the sale of the returned product will be cancelled and a new order for the product ordered will have to be placed.

If a product is to be returned for exchange for a less expensive product, only the purchaser of the returned product will be entitled to a refund of the price difference. If a product is returned for exchange for a more expensive product, you will be required to pay the price difference.

MANUFACTURER'S WARRANTY AND YOUR LEGAL RIGHTS AS A CONSUMER

This article does not apply to purchases with delivery addresses in France: We are committed to ensuring that each product strictly complies with our quality criteria and that it has satisfied all our controls, both technical and aesthetic.

For purchases with delivery to addresses in France: Viltier provides the service of legal guarantees of conformity and that relating to hidden defects of the thing sold from which you could benefit under the French consumer code (articles L 217-3 to L217-20) and the French civil code (articles 1641 to 1649).

The legal guarantee of conformity applies independently of any commercial guarantee that may have been granted.

In accordance with article D211-2 of the French consumer code, we remind you of the content of the following legal provisions.

"The consumer has a period of two years from the delivery of the goods to obtain the implementation of the legal guarantee of conformity in the event of the appearance of a lack of conformity. During this period, the consumer is only required to establish the existence of the lack of conformity and not the date on which it appeared.

"When the contract for the sale of the goods provides for the supply of digital content or a digital service continuously for a period exceeding two years, the legal guarantee is applicable to this digital content or this digital service throughout the period of supply provided for. During this period, the consumer is only required to establish the existence of the lack of conformity affecting the digital content or the digital service and not the date on which it appeared.

“The legal guarantee of conformity entails an obligation for the professional, where applicable, to provide all updates necessary to maintain the conformity of the goods.

“The legal guarantee of conformity gives the consumer the right to repair or replacement of the goods within thirty days of their request, free of charge and without major inconvenience for them.

“If the good is repaired under the legal guarantee of conformity, the consumer benefits from a six-month extension of the initial guarantee.

“If the consumer requests the repair of the goods, but the seller imposes replacement, the legal guarantee of conformity is renewed for a period of two years from the date of replacement of the goods.

"The consumer may obtain a reduction in the purchase price by keeping the goods or terminate the contract by obtaining a full refund against return of the goods, if:

1° The professional refuses to repair or replace the goods;

2° The repair or replacement of the good occurs after a period of thirty days;

3° The repair or replacement of the good causes a major inconvenience for the consumer, in particular when the consumer definitively bears the costs of recovery or removal of the non-compliant good, or if he bears the costs of installation of the repaired or replacement good;

4° The non-conformity of the goods persists despite the seller's unsuccessful attempt to bring them into conformity.

"The consumer is also entitled to a reduction in the price of the goods or to the termination of the contract when the lack of conformity is so serious that it justifies the reduction in the price or the termination of the contract being immediate. The consumer is then not required to request the repair or replacement of the goods beforehand.

“The consumer is not entitled to rescission of the sale if the lack of conformity is minor.

“Any period of immobilization of the property for the purpose of its repair or replacement suspends the guarantee which remained to run until delivery of the repaired property.

“The rights mentioned above result from the application of Articles L. 217-1 to L. 217-32 of the Consumer Code.

"A seller who, in bad faith, obstructs the implementation of the legal guarantee of conformity is liable to a civil fine of up to 300,000 euros, which may be increased to 10% of the average annual turnover ( Article L. 241-5 of the Consumer Code ).

"The consumer also benefits from the legal guarantee of hidden defects in application of articles 1641 to 1649 of the civil code , for a period of two years from the discovery of the defect. This guarantee gives the right to a price reduction if the good is kept or to a full refund against return of the good."

FREE SERVICES

The following services may be offered free of charge through the Sales Channels:

Gift Wrap and Packaging

All orders will be shipped with the Viltier gift box wrapped in Viltier packaging, as well as a Viltier shopping bag (if applicable).

Engravings

Engraving can be offered on specific products.

If you wish to have a Viltier product engraved, please provide the data to the Customer Relations Center or, if available, indicate them on the Platforms.

Orders for custom Viltier products are non-cancellable and cannot be returned for exchange or refund. Please see our Return and Exchange Policy for more information.

Message

You can personalize your order by adding a personalized message that Viltier will print on a gift card included in your package. Viltier reserves the right to reject any gift card message that it deems offensive or inappropriate.

REPAIR

For any repair request relating to a product ordered through the Sales Channels, please refer to our FAQ section or contact our Customer Relations Center.

PRODUCT DESCRIPTION

The description of each product as well as its essential properties and characteristics are presented on the Platform. Be sure to read them before placing your order.

The photographs presented on the site are not contractual.

LIMITATION OF LIABILITY

To the fullest extent permitted by applicable law, we disclaim and exclude all other terms, conditions and warranties relating to the Products and Sales Channels, whether express or implied or otherwise, or arising from any prior dealing, usage or trade practice.

Nothing in these Terms of Sale limits or excludes our liability for any liability that cannot be limited or excluded by applicable law. Subject to the preceding sentence, our total liability to you under these Terms of Sale in respect of any order, whether in contract, tort (including negligence) or otherwise, even if we have been advised of the possibility of such damages, will in no event exceed one hundred percent (100%) of the price of the product(s) in your order.

Please note that in some countries, consumer protection legislation may not provide certain exclusions or limitations of warranties or liabilities, and therefore some of the above exclusions and limitations may not apply.

GENERAL PROVISIONS

If any provision, or part of a provision, of these Terms of Sale is found to be unlawful, void or unenforceable, that provision or part-provision will be deemed not to form part of these Terms of Sale, and the legality, validity or enforceability of the remaining provisions of these Terms of Sale will not be affected, unless applicable law requires otherwise.

These Terms of Sale (and any related terms incorporated by reference) constitute the entire agreement between you and us in respect of the order of products or services, and supersede and replace all prior agreements, draft agreements, arrangements, undertakings or collateral contracts of any nature whatsoever between the parties, whether oral or written, with respect to such subject matter.

We shall not be liable for any failure to perform or delay in performance or failure to comply with our obligations under these Terms of Sale arising from any cause beyond our control.

Our waiver of any breach of any provision of these Terms of Sale shall not be construed as a waiver of any other or subsequent breach.

This contract is between you and us. No other person will have any rights to enforce any of its terms. However, if you purchase a product as a gift, the recipient of your gift will benefit from the applicable Viltier Guarantee.


APPLICABLE LAW AND JURISDICTION

These Terms of Sale shall be governed by and construed in accordance with the laws of the country where the Selling Entity’s registered office is located. The Selling Entity has its registered office, without reference to any conflict of laws provisions (“Applicable Laws”). Any dispute, controversy or claim arising out of or relating to the Terms of Sale, including the validity, invalidity, breach or termination of the Terms of Sale, shall be adjudicated or arbitrated in accordance with the Terms of Sale. If the applicable law is different from the consumer law of your country, we will provide you with similar protection.

You may bring proceedings against us either in the courts of the country where the Selling Entity's registered office is located or in the country where you are domiciled. We may also bring proceedings against you in the courts of the country where you are domiciled.

Without any restriction on the filing of any claim before a court in the country in which the registered office of the Selling Entity is registered, you and Viltier will make every effort for a period of thirty (30) days to amicably resolve any dispute or disagreement arising out of or relating to the product, the General Conditions of Sale or any breach thereof.

If you are a consumer residing in the European Union, you have the right to submit your complaint to an Alternative Dispute Resolution institution. For a list of ADR institutions in your country, you can consult the European Commission's Online Dispute Resolution platform at the following address: http://ec.europa.eu/consumers/odr .

For purchases with a delivery address in France: In accordance with Article L. 612-1 of the French Consumer Code, you can use the service of the Association of European Mediators to which we belong free of charge, either online: https://www.mediationconso-ame.com , by completing the form dedicated to this purpose accompanied by the documents supporting your request, or by post: AME Conso, 11 place Dauphine - 75001 PARIS.
